These terms of use, read together with the (i) Privacy Policy, (ii) Delivery Policy, and (v) Refund and Return Policy constitute a legal and binding agreement between you and Gandhi 1944 Company Limited, registered under various authorities, with its registered office at Gandhi 1944 Company Limited (Head Office), 326 Phahurat road, Wang Burapha Phirom, Phra Nakhon, Bangkok 10200 Thailand.

The Agreement, inter alia, provides the terms that govern your access to use (i) Gandhi 1944 Company Limited’s website www.gandhifabrics.com, and (ii) its mobile and tablet applications, (iii) Gandhi 1944 Company Limited’s online fabric destination, which facilitates the purchase of its distinctive fabrics and related accouterments, (“Products”) through the Platforms, and (iv) the purchase of Products, and any other service that may be provided by Gandhi 1944 Company Limited from time to time (collectively referred to as the (“Services”).

You hereby understand and agree that the Agreement forms a binding contract between Gandhi 1944 Company Limited and anyone who accesses, browses, or purchases the Products, you hereby agree to be bound by the terms contained in the Agreement. If you do not agree to the terms contained in the Agreement, you are advised not to proceed with purchasing the Products or using the Services. The terms contained in the Agreement shall be accepted without modification. The use of the Services would constitute acceptance of the terms of the Agreement.

TERMS & CONDITIONS FOR THE PERIOD OF SALE

During Sale

Our sale is applicable on select products, both online and in-store.
We do not accept exchange or return of discounted products unless a defective piece has been shipped to the customer.
All replacements and refunds are processed only after the sale period is over.
All prices are inclusive of applicable taxes
All online or in-store advance booking orders that cannot be partially/fully delivered will be refunded within 15 days from confirmation of cancellation.
In case of any discrepancy in the pricing of a discounted product on account of human error, the amount that appears in the system will be deemed final.
We experience high volumes during the sale and will be unable to cancel any order due to shipment delays. However,we reserve the right to cancel an order on account of non-availability of goods.
We try our best to fulfill every order. In a case a product in our inventory does not meet our quality check, we may have to cancel the order.
Accounting and encashment of credit notes would make those orders ineligible for any further exchanges or refunds.
We take exchange rates and currency volatility into account, with respect to our USD pricing.
All Duties & Taxes for international orders will apply as per the rules of the shipping destination and will be borne by the customer.
However, we’re unable to control any delays caused by country-specific shipping restrictions.
All T&Cs mentioned here are over and above our standard T&Cs.

BILLING

The price of our merchandise as mentioned on www.gandhifabrics.com is the Retail Price for the said product. Such Retail Price shall be inclusive of all local taxes as are applicable in THAILAND. Additional applicable taxes may be charged depending upon the destination where the order has to be shipped to. The tax rate applied and charged upon the order shall include combined tax rate for both state and local tax rates in accordance with the address where the order is being shipped. Gandhi 1944 Company Limited reserves the right to collect taxes and/or such other levy/duty/surcharge that it may have to incur in addition to the normal taxes it may have to pay. We may also charge delivery Charges which may include postal charges/shipment charges etc. That may be applicable for your country.

ORDER CANCELLATION

Due to unavoidable circumstances there may be times when certain orders having been validly placed may not be processed or capable of being dispatched. Gandhi 1944 Company Limited reserves the exclusive right to refuse or cancel any order for any reason. Some situations that may result in your order being canceled shall include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, problems identified by our credit and fraud avoidance department or any defect regarding the quality of the product. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after your credit card/debit card/any other mode of payment has been charged, the said amount will be reversed into your Account/as the case may be to the source of the payment within a period of 15 working days. Any type of voucher used in these orders shall be returned and made available to the user in case of cancellation by Gandhi 1944 Company Limited.

Our shipping and processing charges are intended to compensate Gandhi 1944 Company Limited for the cost of processing your order, handling and packing the products you purchase and delivering them to you. PAYMENT

While availing any of the payment method/s offered by us, we are not responsible or take no liability of whatsoever nature in respect of any loss or damage arising directly or indirectly to you including but not limited to the following: (a) lack of authorisation for any transaction/s; (b) or exceeding the present limit mutually agreed by you and between your “Bank/s”; (c) or any payment issues arising out of the transaction; (d) or decline of transaction for any other reason/s.

All payments made against the purchases/services on www.gandhifabrics.com by you shall be as against the Retail Price displayed on the website and shall be in terms and conditions of the third party Online Payment Gateway Services as adopted and applicable to your transaction as approved by Gandhi 1944 Company Limited. Before shipping your order to you, we may request you to provide supporting documents (including but not limited to Govt. Issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done so as to ensure a safe and a full proof online shopping environment to our users.

Gandhi 1944 Company Limited may employ other third party facilities, for Payments on the Website. Such payments can be made through the electronic transactions, as may be permitted by Gandhi 1944 Company Limited which shall be at its sole discretion. Use of such third party services will be governed by their User Agreement, Seller Terms, Conditions and other rules and policies as may be required and applicable for your nature of activities.

DELIVERY

Gandhi 1944 Company Limited endeavors but does not guarantee delivery of products in the stipulated time period as mentioned on the purchase of the product. In no manner can the contract be repudiated if Gandhi 1944 Company Limited fails to deliver any one or more products in the stipulated time frame. However, if you fail to take the delivery of the goods, Gandhi 1944 Company Limited may at its discretion charge you for additional shipping cost.

LOSS IN TRANSIT

Gandhi 1944 Company Limited accepts no liability for any damage to goods in transit unless notified to the company and the carrier concerned within 48 hours after delivery.

In the case of non-delivery, Gandhi 1944 Company Limited accepts no liability of any sort unless written notice of non-delivery is given to the company within 48 hours after the date of the advice of despatch of the goods Gandhi 1944 Company Limited’s liability for damage in transit or non-delivery of goods duly notified to it in accordance with the above, shall in any event be limited solely to replacement of the goods within a reasonable time, whether non-delivery or damage is due to Gandhi 1944 Company Limited’s negligence or otherwise. Any communication received after 48 hours of delivery shall not qualify for return, even in case the said product has been wrongly delivered.

REFUNDS & RETURNS

Gandhi 1944 Company Limited shall make all endeavors to deliver defect free products to the purchasers. Gandhi 1944 Company Limited does not take title to any returned items purchased by the user unless the item is received by Gandhi 1944 Company Limited. Any item purchased on our website does not qualify for any return unless the product delivered is damaged or has manufacturing defects. The defective and/or damaged goods so received shall be communicated to Gandhi 1944 Company Limited within 48 hours of its receipt. Any communication received after 48 hours of receipt of goods shall not qualify for return, even in case the said product has been wrongly delivered.
